新能源科研測試研究用汽車，客車，摩托車等進口報關通關流程及清關注意事項

一：國家認監委2005年第3號公告(以下簡稱第3號公告,已于2005年3月3日發布，該公告規定了無需辦理或免于辦理強制性產品認證的條件，為保證在進口環節中無需/免于辦理強制性產品認證規定的順利實施，現將有關問題通知如下：

對于可免于辦理強制性產品認證的條件的解釋

1．為科研、測試所需的產品

本款指的科研是對該產品進行研究、開發，以開發、生產出相關產品所需的產品，并不是指進行研究工作所需的科研器材，本款所指的測試是對該產品進行測試以獲得測試數據或測試某一產品的部分性能所必須用到的該產品(如開發測試某一型號的打印機軟件所需進口的少量該型號打印機)。以上產品均不得在境內再次銷售或提供給普通消費者使用。

此類產品的免辦申請人必須是對這些產品進行研究、開發、測試的機構，申請人應證明其有相應的研究、開發、測試能力并提供本次研究、開發、測試計劃書/項目書。鑒于此類產品的特殊性，在廠家自我聲明對其安全性負責后，可免于提供相應的檢測報告或符合性證明。

2．為考核技術引進生產線所需的零部件

本款指的是從國外引進生產線后，需試運行或考核該生產線所需的Z終成品的零部件。

此類產品的免辦申請人必須是使用引進生產線的工廠，申請時應提供引進生產線的有關證明材料。

3．直接為Z終用戶維修目的所需的零部件/產品

此類零部件/產品的免辦申請人必須是維修單位(須提供Z終用戶向其申請維修的相關資料)或Z終用戶。這些零部件/產品的數量應控制在合理范圍內。

本款也適用于少量在用產品出口維修后復進關的情況，但不適用于產品召回改進后復進關的產品。出口維修后復進關免辦的申請人應是使用這些產品的公司，申請人應在申請材料中應提供當時出口時的有關單證。

4．工廠生產線/成套生產線配套所需的設備/零部件(不包含辦公用品)

本款與國家質檢總局《關于民用商品入境驗證工作有關問題的說明》(質檢檢函[2002]55號)“對于進口成套設備、舊機電中夾帶有驗證范圍內商品或為維修成套設備進口驗證范圍內商品的，經各局檢驗監管部門認定，如果所夾帶的驗證范圍內的產品與整機是一起安裝或配套使用，無須提供認證文件直接放行。"的規定并不矛盾，總局的文件解決的是夾帶的問題，而工廠生產線/成套生產線配套用的設備/部件單獨進口時適用本款。需要重點說明的是：不是工廠生產線/成套生產線配套用的物品一律不得免辦(如工廠/公司所需要的辦公用品(如計算機、打印機)等，即使這些辦公用品是海關監管的)。

此類設備/零部件的免辦申請人必須是使用這些設備/零部件的工廠。

5．僅用于商業展示，但不銷售的產品

此類產品的免辦申請人必須是負責商業展示的公司，申請人應在申請材料中表明展示的時間及展示后該產品的處理方式(不得銷售或提供給普通消費者使用)，并保證其不改變產品的用途。

6．暫時進口后需退運出關的產品(含展覽品)

此類產品的免辦申請人必須是使用這些產品的公司，申請人應在申請材料中表明暫時進口的時間。申請人應在申請材料中承諾產品退運出關后兩周內到簽發《免辦Z明》的直屬檢驗檢疫局辦理核銷手續。

7．以整機全數出口為目的而用一般貿易方式進口的零部件

此類零部件/產品的免辦申請人必須是使用這些零部件/產品的工廠，申請人應在申請材料中承諾成品出口后兩周內到簽發《免辦Z明》的直屬檢驗檢疫局辦理核銷手續。

8．以整機全數出口為目的而用進料或來料加工方式進口的零部件

此類零部件/產品的免辦申請人必須是海關《登記手冊》/電子中的工廠，為便利企業，對于此類商品，在廠家自我聲明對其安全性負責后，可免于提供相應的檢測報告或符合性證明。

為便利企業，在監管有效的前提下，對于工廠所在地及進出口報檢均在某一直屬局管轄地內的企業，各直屬檢驗檢疫局可根據本地區的實際情況，采取便利的管理方式。

二：第3號公告中符合免辦條件的進口產品/零部件的免辦工作由使用/研究/展示這些產品/零部件的所在地直屬檢驗檢疫局辦理，自2005年4月1日起，國家認監委不再辦理符合第3號公告中第二款條件的《目錄》中產品的《免于辦理強制性產品認證證明》(以下簡稱《免辦Z明》)。

三：汽車進口海關監管條件是需要辦理進口許可證和3C認證的，可對于國外新型的車輛或是不打算在中國銷售的車輛，國外工廠就不會在中國相關部門辦理3C證明也就是說這種情況在正常情況下無法進口該車輛。根據國家認監委2005年第3號公告第二可免于辦理強制性產品認證的條件，為科研、測試所需的產品（如上），也就是說汽車相關制造或是科研的機構可以用該方式向相關部門遞交資料申請辦理免3C，進口車輛到國內作為科研研發使用。
